From Connie Lee Fowler at the Philyaw Roots List:

Most people think the Philyaws descended from French Huegenots who came to America after the Edict of Nantes was revoked in 1686. There are some who believe the Philyaws entered North Carolina when the Swiss and German Pallantines came to America around 1710. The Swiss Pallantines were people who fled Germany to Switzerland for religious reasons. Many then settled in London. The English Queen helped pay for the movement of the Pallantines to America. The Swiss Pallantines settled in North Carolina in Craven County and created the town of New Bern, named after Berne, Switzerland. The German Pallantines came by ship to Pennsylvania, I believe, but I may not have all these details correct as I am going by memory only. There is some information on the internet about the Pallantines who came to New Bern. The original list is long since gone, but folks at the library have tried to reconstruct the list and they included families who had "foreign sounding names" and they put the Filliaws on that list. Filliaw, Filliyaw, Fillyaw, and Philyaw were all early spellings in records, of which a land grant of 1738 for 640 acres to John Filliyaw seems to be the earliest in the New Bern area and then a will of 1747 for the same John Filliaw. This may be where your family got the original notion that the Philyaws were German. No document so far exists which gives the original homeland of the Philyaws, with the exception of an 1850 census in Tennessee for a later John Philyaw who gave his origin as France.

That has to be an error. First, there are some who list our James Philyaw as James K. instead of James H. At Ryle Oak Cemetary, James has two headstones. The original is barely legible and reads only James Philyaw with his birthdate and date of death. The second one was placed there by a Confederate Veterans group which denotes his service in the NC 3rd Calvary Division in the Civil War and clearly lists James H. Philyaw. He was married only once to Mary Clara Jarman who was born in 1822 and died in 1885. He died in 1901. You can find his will on file in Jones County and also in the North Carolina Archives. It was written in 1885 and later probated after his death in 1901. Final division of lands in 1904 between the children. James and Mary had the following children: Clara born 1849 married John Louis Jarman, Frederick born c. 1851 and of whom the last record I have is a court case dated 1869 which was dropped in 1870 (think he died but not sure), John Robert Philyaw born 1852 and died 1944, Nancy Jane born 1853 and died 1930, I believe (she never married and left all her property to Jenny Garvey Philyaw, the widow of John Robert's first son James, David William Philyaw, and Zachariah Wilson "Jack" Philyaw.
There obviously was no second marriage for Mary since she died first. John Robert was married twice, as his first wife Peony or Penny King died sometime between 1883 and 1888.
He married Susan Ann Jones when she turned 17 in June 1888. She was the daughter of Asa Jones and Bessie Koonce. Her parents died sometime between 1880 and 1883, and Susan along with her brothers and sisters were parcelled out among neighbors and family to earn their keep. She took care of John Robert's first wife who was sick and their 3 kids, a daughter Nannie born 1879 and a set of twins James and Mary born in 1882. She nursed his first wife until she died and she agreed to marry John Robert later (she had no where else to go and could not stay in the house as a teenager). John Robert and Susan had the following children together: Clara, Bettie, Sally (died as infant), Peony (died as infant), Paul, Nellie, Eddie, John David, Zachary "Jack", Jenny Lee, Katie Irene, Thomas, Carl, Hazel (I think I left one out as I am writing from memory). If you have any information on this line I would appreciate it. So far, researchers researching this James Philyaw have been inconclusive in determining who was the father of James Philyawo of Jones County. There is no concrete evidence so far of who his father is. I cannot find a original deed for his land in Jones County. We have theorized that he was the son of John W. Philyaw, the son of Martin Philyaw died 1813, the son of James Philyaw born 1730 and died 1813 who was born to John Filliaw who died in 1747. However, some also believe he was the second son of James Philyaw, Jr. the brother of Martin, who died in 1846. His will dated 1842 mentions sons James H. and James Owen. The James H. referred to in this will lived in Onslow County and was at least 10 years older than my James H. who lived in Jones County. Any info would be helpful.
